This DMCA & Intellectual Property Policy is incorporated into and governed by the Parts2Drive Terms of Service. In the event of a conflict, the Terms of Service control except where prohibited by law.

1. Designated DMCA Agent

Parts2Drive LLC has registered a Designated Agent with the U.S. Copyright Office in accordance with 17 U.S.C. §512(c)(2). Notices of claimed copyright infringement must be directed to:

Designated DMCA Agent

  • Agent: DMCA Agent, Parts2Drive LLC
  • Address: 11671 Moccasin Wallow Rd, Ste 301, Parrish, FL 34219, USA
  • Email: support@parts2drive.com (subject line: “DMCA NOTICE”)
  • Phone: 1-888-723-0041
  • U.S. Copyright Office Registration No.: DMCA-1073763

Notices sent to any other address, email, or department may not receive a timely response and may not be deemed effective under 17 U.S.C. §512.

2. Ownership of Content

Manufacturer trademarks, logos, product images, technical data, fitment data, and brand names remain the property of their respective owners. Parts2Drive uses manufacturer-supplied and licensed distributor content solely to identify, market, and sell genuine aftermarket automotive parts. Such use does not imply endorsement, sponsorship, or affiliation unless expressly stated.

All original Parts2Drive content — including website design, layout, original graphics, original photography, original product descriptions, compilations, text, video, and the “Parts2Drive” name, logo, and marks — is owned by Parts2Drive LLC and protected by U.S. and international intellectual property law. It may not be copied, reproduced, scraped, framed, mirrored, or reused without prior written permission.

3. Anti-Scraping & Automated Harvesting

Automated scraping, crawling, data mining, indexing for commercial resale, or bulk harvesting of our website or catalog — including product descriptions, fitment and application data, pricing, availability, and images — for competitive or commercial purposes is strictly prohibited.

This prohibition extends to circumventing rate limits, access controls, robots.txt directives, or technical protection measures, and to the use of any automated agent, bot, script, or headless browser for the purposes described above. Parts2Drive reserves all rights and remedies, including claims under the Computer Fraud and Abuse Act, the Digital Millennium Copyright Act, and applicable state law.

4. Respect for Intellectual Property

Parts2Drive respects the intellectual property rights of others and does not knowingly publish copyrighted, trademarked, or proprietary material without authorization, license, consent, or other valid legal justification such as fair use. If you believe content on our site infringes your rights, use the procedures below.

5. Filing a DMCA Takedown Notice

If you believe material available on Parts2Drive infringes your copyright, submit a written DMCA Notice to our Designated Agent (Section 1) that includes all of the following, as required by 17 U.S.C. §512(c)(3):

  • Your full legal name, company (if applicable), mailing address, email address, and telephone number.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice.
  • Identification of the allegedly infringing material, including the exact URL(s) where it appears. General homepage or shop links are insufficient to permit location of the material.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature.

Incomplete notices may not be actionable. We may contact you to request the missing elements before taking action.

6. Our Response to a Valid Notice

Upon receipt of a notice that substantially complies with 17 U.S.C. §512(c)(3), Parts2Drive will:

  • Expeditiously remove or disable access to the material identified in the notice.
  • Take reasonable steps to promptly notify the user or party who submitted or is responsible for the material that it has been removed or disabled and provide a copy of the notice.
  • Inform that party of their right to submit a counter-notification under Section 7.
  • Document the notice and our response in our infringement records for purposes of Section 9.

We may, at our discretion, decline to act on notices that are facially deficient, that concern material we do not host or control, or that appear to be submitted in bad faith.

7. Counter-Notification

If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing all of the following, as required by 17 U.S.C. §512(g)(3):

  • Your full legal name, mailing address, email address, and telephone number.
  • Identification of the material that was removed or disabled and the location at which it appeared before removal.
  • A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the United States District Court for the Middle District of Florida (or, if outside the United States, to the jurisdiction of any judicial district in which Parts2Drive may be found), and that you will accept service of process from the party who filed the original notice or that party’s agent.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly forward it to the original claimant. Unless the claimant notifies us within ten (10) business days that it has filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the material in not less than ten (10) nor more than fourteen (14) business days following receipt of the counter-notification, consistent with 17 U.S.C. §512(g)(2).

8. Trademark Complaints

Trademark owners who believe their marks are being used improperly on our site may contact us at support@parts2drive.com with: proof of ownership or registration; a description of the alleged misuse; the exact URL(s) at issue; and contact information. We will review and take appropriate action, which may include removal, modification, or clarification of the use.

Note: Nominative fair use of manufacturer names and part numbers to accurately identify products offered for sale is permitted under U.S. trademark law. We use manufacturer marks solely for identification of genuine products and do not claim affiliation or endorsement.

9. Repeat Infringer Policy

In accordance with 17 U.S.C. §512(i), Parts2Drive has adopted and reasonably implements the following policy for the termination of repeat infringers:

  • We maintain a record of each valid DMCA notice received, including the party responsible for the material and the date and disposition of the notice.
  • A user or account that is the subject of a first valid notice receives a written warning and the material is removed.
  • A user or account that is the subject of a second valid notice receives a final written warning, and account privileges, including content submission and review posting, may be suspended.
  • A user or account that is the subject of three (3) valid notices within any twelve (12) month period will have its account terminated, and we may cancel pending orders and refuse future service.
  • Notices withdrawn by the claimant or successfully rebutted by counter-notification without a subsequent court action, are not counted toward this total.
  • We reserve the right to terminate any account immediately, without prior warning, in cases of egregious, willful, or large-scale infringement.

This policy is applied in a manner reasonably designed to identify and terminate repeat infringers in appropriate circumstances.

10. Misuse of This Process

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Parts2Drive reserves all rights to pursue such damages against parties submitting false, misleading, or bad-faith notices or counter-notices, including notices submitted for anticompetitive purposes.

11. No Admission of Liability

Removal, disabling, or restriction of content in response to a notice does not constitute an admission of wrongdoing, infringement, or liability by Parts2Drive, and does not waive any defense or right.

12. Modifications

We may update this Policy from time to time. Changes are effective when posted with a revised “Last Updated” date. If our Designated Agent information changes, we will update this page and our registration with the U.S. Copyright Office.

13. Governing Law

This Policy is governed by the laws of the State of Florida and by the United States Copyright Act, including the Digital Millennium Copyright Act (17 U.S.C. §512). Dispute resolution, arbitration, and venue provisions of the Terms of Service apply, except that intellectual property claims may be brought in court as provided in Section 17.3 of the Terms of Service.
